This is actually a question we’re asked quite often. Let’s say someone is arrested and they call their boyfriend or girlfriend from behind bars, and that person starts the process of hiring a bondsman.
While all of this is going on, the defendant’s parents have found out about the arrest and they start working with a bondsman of their own. How does this pan out? Will the jail take two bail bonds on the same defendant?
The quick answer to this question is no.
If the defendant has one bail, only one bail bond can be posted and ultimately, the jail will accept paperwork from whichever bondsman gets there first. Many bail agents have found themselves in this very position; mom, dad and the defendant’s husband/wife are all working on different things at the same time, and when it comes time for the bond to be posted, the second and third bail agent that show up at the jail are turned away.
The good news is that the bondsman’s fee is not considered to be earned until the bail bond is posted; if someone else posts bail bonds before you do, the fee you paid to the agent will need to be refunded.
