Generally, someone who is arrested for the first-time on a DUI offense, they will not be required to post bail if they are a Nevada resident with a Nevada Driver's License because people are usually cited out on a first offense DUI arrest or OR'd .
Recently, I received a call from a woman who was inquiring about Bailing her daughter out of CCDC. She said her daughter had never been arrested before and that her daughter has lived in Nevada her whole life. She was arrested for a DUI. I explained to her she probably will not have to post bail because it is likely her daughter will be cited out / OR'd after the booking process was complete.
The woman told me another bail bonds company had pressured her to meet with them right away to pay for her bail bond. I explained that the jail won't even accept a bail bond until the booking process has been completed. Since there was a good chance her daughter was going to be released on her own recognizance, it did not make sense to rush down there to pay for a bail bond she most likely was not going to need. If she paid for a bail bond and her daughter was released on the bail bond, she would not be entitled to any type of refund even if the jail would have released her daughter without a bail bond.
Maybe the bail agent she spoke to at the other company was new and inexperienced, it's often better to give people the benefit of doubt when unsure of why they did something. The woman's daughter was released later that evening...without having to post bail.
